Entity: W.Canvas LLC, doing business as “Buddd” (“Buddd,” “we,” “us,” “our”)
Service: buddd.ai and related apps, APIs, and integrations (the “Service”)
1. Agreement to Terms
By accessing or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent you have authority to bind that organization. You must be at least 18 years old. If you do not agree, you may not use the Service.
2. The Service
Buddd provides AI-powered tools that assist with web and software development by generating or suggesting code, documentation, and other project materials from your inputs. Features may include integrations with design tools, version control systems, and project management platforms. The Service is constantly evolving and may change without prior notice.
3. Accounts and Security
To use the Service, you must create an account. You are responsible for safeguarding your login credentials and for all activity under your account. Please notify us immediately of any unauthorized access.
4. Confidentiality
Buddd will treat your project information and Customer Content as confidential. We will not disclose, share, or publish any information about your projects without your express written consent, except as required by law or as necessary to provide the Service.
5. Intellectual Property
Customer Ownership: You retain ownership of all content, inputs, and outputs generated through your use of the Service. This includes code, assets, and project deliverables created using the AI.
Buddd’s Rights: We do not claim ownership of your projects, and we will not re-use, resell, or publish your project outputs without your express consent.
License for Service Operation: You grant us a limited license to process your content and outputs solely to provide, maintain, and improve the Service.
6. Project Use and AI Improvement
To improve our models, Buddd may use data generated from projects (including inputs and outputs) for retraining, fine-tuning, or system improvement. Where possible, we will de-identify or aggregate data. If you wish to opt out of this use, please contact us at [email protected].
7. Acceptable Use
You may not use the Service to:
Violate applicable law or infringe rights of others.
Submit sensitive data (such as health data, payment card numbers, minors’ information).
Upload malicious code or interfere with system security.
Generate or distribute unlawful or harmful content.
8. AI Limitations & Disclaimer of Outputs
Buddd uses AI systems that can make mistakes. Outputs may contain errors, bugs, or security vulnerabilities. The Service does not produce production-ready websites or software. You must review and test all outputs before using them in a live environment. Buddd is not responsible for damages, security breaches, or bugs resulting from use of outputs.
9. Payment and Fees
Paid plans are billed in advance through authorized third-party payment providers (such as Stripe). Fees are non-refundable except where required by law.
10. Confidentiality of Customer Data
Both parties agree to keep confidential information safe and not disclose it to third parties without consent, except as required by law. “Confidential Information” includes non-public project data, business processes, and Customer Content.
11. Vendor and Subprocessor Use
Buddd relies on trusted third-party vendors to provide the Service, including but not limited to:
OpenAI
Anthropic
Google Gemini
LangSmith
GitHub
Notion
Slack
Figma
These vendors may process your data as part of providing their underlying services.
12. Security
We use reasonable safeguards such as encryption in transit (HTTPS), industry-standard cloud hosting, and access controls to protect your data. No system is perfectly secure, and we cannot guarantee absolute protection against all threats.
13. Confidentiality of Logos and Publicity
Unless you notify us otherwise in writing, you grant Buddd permission to use your company’s name and logo for the limited purpose of identifying you as a customer in marketing materials, presentations, or on our website.
14. Limitation of Liability
To the maximum extent permitted by law:
Buddd will not be liable for indirect, incidental, or consequential damages, including lost profits, revenues, or data.
Buddd’s total liability in any 12-month period is limited to the greater of (a) the amount you paid to Buddd during that period or (b) USD $100.
15. Termination
You may stop using the Service at any time. We may suspend or terminate your account if you breach these Terms, pose a security risk, or as required by law.
16. Governing Law
These Terms are governed by the laws of New York, USA, and courts in that jurisdiction have exclusive authority.
